He earned his law degrees in Ukraine and from July 2010 to December 2018 served in the Security Service of Ukraine, rising to Senior Detective for Especially Important Cases. What this practice does

  • Complaints under 28 U.S.C. § 1581(i) at the U.S. Court of International Trade to recover duties collected under the International Emergency Economic Powers Act. The firm files its own complaints.
  • Administrative protests under 19 U.S.C. § 1514, which must be filed within 180 days of liquidation.
  • Guidance on CBP’s Consolidated Administration and Processing of Entries process. The importer of record or the customs broker that filed the entries files the CAPE declaration in the ACE Portal; the firm obtains the court order that makes a finally liquidated entry eligible.
  • Customs penalty, seizure and classification matters for importers.

Importers outside the United States

An IEEPA duty refund belongs to the importer of record. A foreign exporter, supplier, freight forwarder or consignee has no refund claim unless it is itself the importer of record. A company based outside the United States may act as importer of record in its own name, and the firm represents importers of record in that position as well as United States subsidiaries of foreign parent companies. The firm represents importers of record on entries of merchandise originating in more than twenty countries across Asia, Europe, North and Central America, South America, the Middle East and Africa.

Fees

The attorney fee is 2% of the refund where a CAPE declaration is sufficient, and 7% of the refund where a Court of International Trade complaint is required, or a flat fee of $2,000 where the refund is under $29,000. There is no attorney fee unless we recover. The client is responsible for case costs, including the $400 court filing fee and approximately $40 for service by mail. No result is guaranteed, and prior results do not guarantee a similar outcome.

Fees, Costs and Case Results

Where representation is offered on a contingency basis there is no attorney fee unless we recover, and the firm advances case costs — filing fees, expert witnesses and medical records — which are then repaid out of any recovery. If there is no recovery, you owe no attorney fee. The specific terms that apply to a matter are set out in the written fee agreement for that matter.

Where this site refers to a verdict, settlement or court order, that result was dependent on the facts of that case, and results will differ if based on different facts. Past results do not predict or guarantee the outcome of any other matter, and no particular outcome is promised or guaranteed.
