Employment Law for California Employers

Employer-side employment counsel for California businesses: flat $2,000/month subscription or hourly. Handbooks, terminations, wage and hour, PAGA.

Trembach Law Firm represents California employers. We help businesses stay compliant with California and federal employment law, build the policies and documentation that reduce the risk of claims, and defend employers when disputes arise. For businesses that do not have a general counsel, we work as outside employment counsel for a flat monthly fee. One-off matters and litigation are handled hourly. No particular outcome is guaranteed; results depend on the facts of each matter.

Frequently Asked Questions

Does Trembach Law Firm represent employees or employers?
Our employment practice represents employers. We provide employer-side advice, compliance, and defense for California businesses.
How much does the employer subscription cost?
The employer subscription is a flat $2,000 per month and covers ongoing employment counsel with no cap on the number of advisory and compliance matters (policies, handbooks, training, day-to-day HR questions, and agreement review). Litigation and agency defense are not included in the subscription. Without a subscription, services are billed at $500 per hour. Fee terms are set out in a written agreement.
Who is the employer subscription designed for?
It is designed for California small and mid-size businesses that do not have a general counsel or an in-house employment lawyer, but need regular access to employment counsel for handbooks, policies, terminations, classification questions, and HR issues, at a fixed and predictable monthly cost.
What is not included in the subscription?
Litigation and agency defense, such as defending a lawsuit, an arbitration, a PAGA action, a Labor Commissioner hearing, or a Civil Rights Department or EEOC charge, are not included. Those matters are handled under a separate written engagement and billed at $500 per hour.
Is California an at-will employment state?
Yes. Under Labor Code Section 2922, California employment is generally at will, which means either party may end the relationship at any time. A termination can still be unlawful if it breaches an express or implied contract, violates a statute such as FEHA, or violates a fundamental public policy, so process and documentation matter.
Which employers must provide harassment-prevention training?
California employers with five or more employees must provide harassment-prevention training: two hours for supervisors and one hour for nonsupervisory employees, repeated every two years. Training must also be provided to new employees and newly promoted supervisors within six months.
What is a PAGA action?
The Private Attorneys General Act (Labor Code Section 2698 and following) lets an aggrieved employee bring a representative action against an employer for Labor Code civil penalties on behalf of the State of California. PAGA exposure can be significant, so early assessment and compliance are important.

Fees, Costs and Case Results

Where representation is offered on a contingency basis there is no attorney fee unless we recover, and the firm advances case costs — filing fees, expert witnesses and medical records — which are then repaid out of any recovery. If there is no recovery, you owe no attorney fee. The specific terms that apply to a matter are set out in the written fee agreement for that matter.

Where this site refers to a verdict, settlement or court order, that result was dependent on the facts of that case, and results will differ if based on different facts. Past results do not predict or guarantee the outcome of any other matter, and no particular outcome is promised or guaranteed.
