How are Chapter 13 payments calculated?
Chapter 13 payments are based on your disposable income (gross income minus allowed expenses). You pay this amount monthly for 3-5 years. The plan must pay priority debts in full, secured debts per contract (or as modified), and unsecured creditors receive whatever remains - often pennies on the dollar.
Can I afford Chapter 13 if I have no disposable income?
If you have no disposable income after allowed expenses, Chapter 13 may not be feasible. However, California's generous exemptions under Chapter 7 might better protect your assets. Some debtors create disposable income by surrendering property or modifying secured debt payments through the plan.
What's the difference between 36-month and 60-month plans?
If your household income is below California's median, you can choose a 3-year (36-month) plan. Above-median debtors must commit to 5 years (60 months). Longer plans pay more total to unsecured creditors but have lower monthly payments. The court may require 5 years even for below-median debtors if needed to pay secured/priority debts.
What debts must be paid in full?
Priority debts (recent taxes, child support arrears, bankruptcy filing fees) must be paid 100% through the plan. Secured debts (mortgage, car loans) must be paid per contract or as modified by the plan. Unsecured creditors (credit cards, medical bills) receive the remainder - often just a percentage.
Can I modify my Chapter 13 payment later?
Yes. You can request plan modification if your financial circumstances change (job loss, medical emergency, income increase). The court must approve modifications. You can also convert to Chapter 7 if eligible, or dismiss the case entirely, though this has consequences.
